Initiated in 2017 by the Association Henri Capitant, with the support of the Fondation pour le droit continental and a number of partners, the work on a Draft European Business Code follows on from the inventory published by the Association in 2016 (La construction européenne en droit des affaires, acquis et perspectives, ed. Lextenso).
This initiative of civil society has brought together for several years nearly a hundred academics and practitioners working – on a voluntary basis and without any national or European mission statement – in favour of a more coherent construction of European business law.
On this website, a first version of the 13 Books making up this Code can be consulted in the form of simple preliminary drafts, in a perfectly provisional version, for the sole purpose of participative discussion and improvement.
A work of this magnitude is bound to be perfectible and calls for an immense amount of harmonisation, consultation and discussion. It will undoubtedly evolve significantly and be improved thanks to the invaluable assistance of lawyers from all countries.
The aim of the draft European Business Code is to raise the profile of the European Union by highlighting the codification shared by so many countries, while promoting economic growth in the area and the completion of the common market. In this respect, the introduction of new European contractual instruments could be a major step forward.
